1) Eligibility (17+)
The Service is intended for users who are at least 17 years old. By using the Service, you represent that you are 17 or older and that you have the legal capacity to enter into these Terms.
2) The service
Lussi - AI-Powered Beverage Analysis and Content Generation.
The Service helps you transform beverage photos and related inputs into analysis and professional content for your needs. Features may change over time.
3) Account registration and security
To use certain features, you may need an account. You agree to provide accurate information (such as name, username, and email) and keep it up to date.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
You must notify us promptly if you suspect unauthorized access to your account.
4) User content and AI inputs
“User Content” means content you submit to the Service, including beverage photos, text prompts, and support communications.
You retain ownership of your User Content. However, you grant Lussi Team a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your User Content only as necessary to:
- Provide and operate the Service
- Perform AI-powered analysis and content generation you request
- Maintain security, prevent abuse, and troubleshoot issues
AI processing:
- Uploading photos/text for AI features is optional, and you control whether to upload and generate content.
- We process AI Inputs on servers controlled by Lussi Team.
- We do not share your AI Inputs with third-party AI providers for processing.
- We do not use AI Inputs to train machine learning models or for advertising/marketing profiling.
- AI Inputs and generated outputs are deleted from our servers promptly after processing, and results may be stored locally on your device by default (depending on your device settings and your choices).
5) Acceptable use
You agree not to misuse the Service. You must not, and must not attempt to:
- Break the law using the Service
- Upload content you do not have the right to use or that infringes intellectual property or privacy rights
- Upload illegal, harmful, or abusive content
- Attempt to reverse engineer, decompile, or discover source code except to the extent such restrictions are prohibited by law
- Interfere with or disrupt the Service (including probing, scanning, or testing vulnerabilities without authorization)
- Use automated means to access the Service in a way that harms performance or bypasses limits
We may remove content or restrict access if we reasonably believe it violates these Terms or applicable law.
6) Subscriptions / fees (if applicable)
If the Service offers paid features, pricing and subscription terms will be shown to you at purchase time. Payments are processed through the app store provider. Refunds and cancellations are subject to the app store’s policies and applicable law.
7) Third-party services
The Service may interact with third-party services or features you choose to use (for example, device backups or sharing). We are not responsible for third-party services and your use of them is governed by their terms and policies.
8) Privacy
Our handling of personal information is described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
9) Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service (in whole or in part) if we reasonably believe you violated these Terms, created risk, or used the Service unlawfully.
Upon termination, your right to use the Service will stop. Sections that by their nature should survive will survive (including intellectual property, disclaimers, limitation of liability, and dispute resolution).
10) Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
AI-generated outputs may be inaccurate, incomplete, or not suitable for your specific purpose. You are responsible for how you use the outputs and for verifying them as appropriate.
11) Limitation of liability
To the maximum extent permitted by law, Lussi Team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of (or inability to use) the Service.
To the maximum extent permitted by law, Lussi Team’s total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to use the Service in the 12 months before the event giving rise to the claim, or USD $10 if you paid nothing.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12) Changes to the service or terms
We may update the Service and these Terms from time to time. We will post the updated Terms with a new effective date. If changes are material, we may provide additional notice as required by law. Your continued use of the Service after the effective date means you accept the updated Terms.
13) Governing law
These Terms are governed by the laws of the jurisdiction of Lussi Team’s primary place of business, without regard to conflict of laws principles.
14) Dispute resolution and binding arbitration
Please read this section carefully. It affects your rights.
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, rather than in court.
Arbitration will:
- Be conducted in English
- Be administered by a recognized arbitration provider mutually agreed by the parties, or, if not agreed, appointed by a court of competent jurisdiction
- Take place in the jurisdiction of Lussi Team’s primary place of business, unless the parties agree otherwise
Class action waiver:
To the extent permitted by law, you and Lussi Team agree to bring claims only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for misuse of intellectual property or unauthorized access to the Service, to the extent permitted by law.
